Terms of Service
These terms define the rules and safety limitations for using FallGuard for Ring.
Acceptance of terms
These Terms govern access to and use of FallGuard. By creating an account, linking Ring, purchasing a subscription, or using FallGuard, you agree to these Terms. If you do not agree, do not use the service.
FallGuard may require an affirmative checkbox or in-app confirmation when you create an account or when Terms or Privacy Policy changes are material. FallGuard may record the acceptance date, accepted Terms version, accepted Privacy Policy version, IP address, and browser/user-agent information for compliance and dispute prevention.
Critical safety terms
- FallGuard is not a medical device, emergency response device, professional monitoring service, life-safety system, or substitute for 911 or local emergency services.
- FallGuard has not been reviewed, cleared, or approved by the U.S. Food and Drug Administration.
- FallGuard is not intended to diagnose, treat, cure, mitigate, or prevent any disease, medical condition, injury, or disability.
- FallGuard provides possible fall review only. It can miss falls, flag non-falls, fail to process clips, process clips late, or become unavailable.
- FallGuard detection scores, timestamps, explanations, labels, and alert reasons are automated estimates for review and may be incomplete, delayed, inaccurate, or affected by camera angle, lighting, motion, occlusion, privacy zones, clothing, furniture, pets, visitors, internet outages, Ring settings, or third-party service issues.
- FallGuard does not guarantee detection accuracy, response time, alert delivery, camera availability, internet connectivity, Ring API availability, SMS/email delivery, or any emergency outcome.
- If someone may be injured, in danger, or needs urgent help, contact emergency services directly.
User responsibilities
- Maintain working Ring cameras, power, internet, subscriptions, account linking, alert contacts, and correct settings.
- Review FallGuard results before taking action. Do not treat a possible fall result as a medical diagnosis.
- Call emergency services directly if someone may be injured, in danger, unresponsive, or needs urgent help. Do not wait for FallGuard to send, repeat, confirm, or escalate an alert.
- Configure Ring privacy zones, motion zones, camera placement, and recording settings for the camera location before enabling FallGuard processing.
- Get all required rights, permissions, consents, notices, and approvals for camera placement and people who may be recorded or analyzed.
- Use FallGuard only for lawful purposes and not for surveillance, harassment, discrimination, or any prohibited activity.
- Keep login credentials confidential and immediately report unauthorized access.
Ring, SMS, and third-party services
FallGuard depends on third-party services including Ring/Amazon APIs, optional Twilio SMS, email providers, hosting, and network providers. FallGuard is not responsible for third-party outages, API changes, delayed webhooks, unavailable clips, failed SMS/email delivery, billing issues, or account restrictions.
Email, SMS, push, carrier, internet, device, and Ring services may delay, block, filter, throttle, fail to deliver, or duplicate messages or event data. FallGuard is not responsible for actions or inactions of mobile carriers, email providers, Ring, Amazon, Twilio, internet providers, device manufacturers, or emergency services.
SMS alert terms
- Program name: FallGuard SMS Alerts.
- Program description: FallGuard sends user-requested transactional SMS alerts about high-confidence possible fall events detected by connected camera clips. Messages are not marketing messages.
- Message frequency varies based on account settings, connected cameras, high-confidence possible fall events, and SMS limits.
- Message and data rates may apply according to your mobile carrier plan.
- Consent to receive SMS alerts is not required to purchase FallGuard.
- Reply STOP to opt out of SMS alerts. Reply HELP for help.
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
- SMS opt-in data and messaging consent are not sold, rented, or shared with third parties or affiliates for their own marketing, advertising, lead generation, or promotional purposes.
- You can also contact support at support@getfallguard.com or manage SMS settings in your FallGuard account.
Subscriptions and billing
- Paid Ring camera plans are purchased and managed through Ring unless FallGuard and Ring approve another billing channel in writing.
- Plan features, camera limits, alert channels, contact limits, and history windows are controlled by the active subscription assigned to the account.
- FallGuard syncs Ring subscription status from Ring webhooks and maps Ring Plan IDs to the app limits shown in the plan table.
- Fees are non-refundable except where required by law or expressly stated by the billing provider.
- FallGuard may suspend or limit processing if a subscription is inactive, canceled, unpaid, past due, or appears abusive.
Automated analysis and AI limitations
- FallGuard uses automated, AI-assisted pose and motion analysis to estimate possible fall indicators from eligible Ring motion clips and uploaded test clips.
- Detection outputs, confidence scores, event timing, posture labels, stillness estimates, and written reasons are automated estimates for review only.
- FallGuard does not provide medical diagnosis, emergency dispatch, professional monitoring, biometric identification, identity verification, or guaranteed fall detection.
- FallGuard may miss real falls, flag non-falls, delay alerts, fail to process a clip, or produce incomplete results because of camera angle, lighting, motion, occlusion, clip length, Ring settings, privacy zones, internet availability, or other service limits.
- FallGuard does not use Ring video clips, video frames, motion events, device metadata, detection outputs, or customer alert decisions to train AI or machine learning models.
- FallGuard does not use facial recognition, identify individuals, or create faceprints, voiceprints, fingerprints, iris scans, or biometric identifiers for identifying a person.
Data and privacy
Use of FallGuard is also governed by the Privacy Policy. You authorize FallGuard to process Ring motion clips, event metadata, detection outputs, settings, and alert contacts as needed to provide the service.
Review-media retention depends on your settings and active plan. Turning off review-media storage deletes clip/pose media after processing while retaining the detection result needed for service records and alerts.
Users can manage alert channels, contacts, review-media storage, retained alerts, Ring account access, and account deletion through available dashboard controls or by contacting support.
FallGuard analyzes the clip and event data Ring provides after Ring-side camera controls, including privacy zones and motion settings, are applied. FallGuard does not attempt to reconstruct masked areas.
FallGuard is not a HIPAA covered entity or HIPAA business associate unless a separate written agreement expressly says otherwise. Do not submit protected health information, medical records, diagnosis details, treatment information, insurance information, or unnecessary health information to FallGuard.
Dispute resolution, arbitration, and class action waiver
Please read this section carefully. It affects your legal rights.
Before either party starts arbitration or a small-claims case, you and FallGuard agree to first try to resolve the dispute informally. The party raising the dispute must send written notice describing the claim, requested relief, and contact information. Notices to FallGuard must be sent to support@getfallguard.com with the subject line "Legal Dispute Notice." FallGuard will send notices to the email address associated with your account. The parties will have 30 days after notice is received to try to resolve the dispute informally.
If a dispute is not resolved informally, you and FallGuard agree that any dispute, claim, or controversy arising out of or relating to FallGuard, these Terms, the Privacy Policy, billing, subscriptions, alerts, detection results, account access, Ring integration, SMS/email communications, or your use of the service will be resolved by binding individual arbitration, except for the exceptions below.
Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, or by another neutral arbitration provider agreed to by both parties if AAA is unavailable or declines to administer the arbitration. The arbitrator will have authority to decide all issues except those these Terms expressly reserve for a court.
You and FallGuard agree that each may bring claims only on an individual basis and not as a plaintiff, class member, representative, private attorney general, or participant in any class, collective, consolidated, mass, or representative action. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party's claim. To the fullest extent permitted by law, you and FallGuard waive the right to a jury trial for any dispute covered by this section.
Either party may bring an individual claim in small claims court if the claim qualifies. Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, account security, service integrity, or unauthorized access. Nothing in this section prevents either party from contacting a government agency or law enforcement.
Arbitration may be conducted by video, phone, written submissions, or in person as allowed by the arbitration provider's rules. If an in-person hearing is required, it will take place in the county and state where you reside unless the parties agree otherwise or the arbitrator determines another location is required by applicable law.
Arbitration fees will be governed by the arbitration provider's consumer rules and applicable law. FallGuard will pay any fees it is required to pay under those rules or applicable law. If the arbitrator determines that a claim was frivolous or brought for an improper purpose, the arbitrator may award fees and costs as allowed by law and the arbitration rules.
You may opt out of this arbitration agreement and class action waiver within 30 days after first accepting these Terms by emailing support@getfallguard.com with the subject line "Arbitration Opt Out." Your email must include your name, account email address, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
If any part of this arbitration section is found unenforceable, the unenforceable part will be severed and the remaining parts will remain in effect, except that if the class action waiver is found unenforceable for a claim, then the arbitration agreement will not apply to that claim.
These Terms and this arbitration agreement are governed by the Federal Arbitration Act and, to the extent not preempted by federal law, the laws of the State of Florida, without regard to conflict-of-law rules. For any dispute that is not subject to arbitration or small claims court, the state and federal courts located in Florida will have exclusive jurisdiction, and you consent to personal jurisdiction in those courts.
Changes and availability
FallGuard features may be updated, refined, limited, or discontinued as the service improves. Detection behavior, AI capabilities, data use disclosures, and accuracy-related notices may change over time and may be communicated through in-app notices, support documentation, updated Terms, or updated Privacy Policy notices as appropriate. FallGuard may update these Terms by posting a revised version with a new date. Continued use after changes means acceptance of the updated Terms.
Disclaimers and limitation of liability
FallGuard is provided "as is" and "as available" to the maximum extent permitted by law. FallGuard disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.
To the maximum extent permitted by law, FallGuard will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including injury, death, property loss, lost profits, lost data, missed alerts, false alerts, delayed alerts, failed clip processing, or third-party service failures. Where liability cannot be excluded, the total liability of FallGuard is limited to the amounts paid for the service in the three months before the event giving rise to the claim.
Indemnity
You agree to defend, indemnify, and hold harmless FallGuard from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, camera placement, lack of permissions or consents, unlawful use, breach of these Terms, or misuse of alerts/results.
